TERMS, CONDITIONS & AWARDS
1) Green Side Up Contracting Inc & any sub-trade have WSIB covering its employees.
Green Side Up Contracting Inc’s WSIB Firm number is 768233FY and the account
number is 5560678.
2) Green Side Up Contracting Inc. carries $5,000,000 CAD Commercial General
Liability Insurance. The Insurer is AIG Insurance of Canada and the policy number
is 60729671. Expiration is December 11th 2019
A. Carpentry: 5 year warranty which covers critical items such as post installation and structural integrity of framing. Cracked / twisted posts or boards are not covered under warranty. Pressure Treated lumber is coloured a sienna brown. Please note that during production at the mill, there can be a variance in shade of colour which will blend / fade over time.
B. Interior Construction: Interior construction: 5 years on all workmanship.
C. Landscape Construction: one year warranty on all workmanship. This does not include any warranty on the product such as imperfections in any stone such as pitting, efflorescence or salt damage.
C.1 During excavation if there is a need for addition excavation (unforeseen issues below grade) client will be notified and there will an additional fee to remove and correctly back fill the area to prevent future problems.
Warranty is non-transferable
A. The owner warrants that he/she is the lawful owner of the land and premise and the location selected by him/her is such that all construction will be entirely within that boundaries of the owner’s property and will not violate any municipal or other restrictions zoning ordinance, or set-back requirements whatsoever, and shall indemnify and save harmless the contractor from any breaches thereof.
B. The owner shall obtain and pay for all necessary permits, approval, licenses or consents required by law or by-law or by any municipal or other authority for the execution of the work, and comply with all laws, ordinances, rules and regulations relating to the work the preservation of public health and safety, and shall indemnify and hold harmless the contractor from any damages arising from any breaches thereof.
C. Owner is responsible to identify property lines (www.protectyour-boundaries.ca), irrigation, lighting, private gas lines, electrical lines or any other in ground services. The contractor will not be held responsible for any damages incurred.
D. The contractor will take responsibility for location/stake out of all public utility locates (eg: cable, TV, gas, telephone, hydro and water)
E. Should the contractor encounter underground obstruction such as underground pipes, wires, cables, conduits, water strata or sewage, hard rock or filled ground or any other hazards not visible to the eye, the owner agrees to pay any additional costs incurred by the contractor because of the obstructions. If the additional work caused by said obstructions is done by contractors staff and equipment, the owner agrees to pay
Costs of men and equipment at revealing wages and rentals plus 10%. Said payment to be over and above price stipulated within the original price.
E 2. In the event where cannot set a footing for a post 48” deep due to any obstruction, we will excavate as deep as possible
F 3. In the event where interlock asphalt or any other artscaping is on or close to the fence line and has to be distributed we will do our best to put it back how we found it originally but ultimately this will not be our responsibility.
F 4. Same above applies to interior construction. We cannot be held responsible for anything unseen behind the walls.
G) The owner shall provide access as well as water and electrical power to the site for all the necessary equipment for the performance of the contractors work.
H) All material remains the property of the contractor and our suppliers, until full payment has been received for job completion. In the event of non-payment, the contractor shall be entitled to enter the premises of the owner and remove any installations, and no action for trespass against the contractor will be taken.
I) This agreement is contingent upon weather, Acts of God, product availability, strikes, accidents or delays beyond the control of the contractor.
J) The contractor shall not be responsible for any unforeseen circumstances which may result in damage to the project (ie: vandalism, Act of God, etc.).
K) Any deviation from agreed specifications and/or terms shall be agreed upon and any additional labour, and or material cost will be the responsibility of the property owner.
L) Third party financing is available upon request.
3. Payment Schedule & Terms:
a) Carpentry: 10% at signing, 40% on project start date, and 50% on completion of
b) Landscape & Interior Construction: 5% at signing, 45% on commencement of project, 25% midway through construction and 25% on completion.
c) Cheque, e-transfer, Visa or MasterCard and cash are accepted. Please note there is 2.9% surcharge applied on credit card transactions. Cheques to be made out to Green Side Up Contracting Inc. Deposits are NON-REFUNDABLE.
